Ez a jogalap term\u00e9szetesen lehet t\u00f6bbf\u00e9le, de az esetek jelent\u0151s r\u00e9sz\u00e9ben <\/span><b>a civil szervezet jogos \u00e9rdek\u00e9re<\/b><span style=\"font-weight: 400;\"> sz\u00fcks\u00e9ges alap\u00edtani az ilyen jelleg\u0171 adatkezel\u00e9seket.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Jogos \u00e9rdeken alapul\u00f3 adatkezel\u00e9s eset\u00e9ben pedig az adatkezel\u0151 k\u00f6teles <\/span><b>\u00e9rdekm\u00e9rlegel\u00e9si teszt<\/b><span style=\"font-weight: 400;\"> elv\u00e9gz\u00e9s\u00e9re. A Hat\u00f3s\u00e1g kiemelte, hogy egy\u00e1ltal\u00e1n nem mindegy ennek az \u00e9rdekm\u00e9rlegel\u00e9si tesztnek a tartalma, nem elegend\u0151 teh\u00e1t egy valamilyen tartalommal l\u00e9trehozott \u201c\u00e9rdekm\u00e9rlegel\u00e9si teszt\u201d elnevez\u00e9s\u0171 dokumentum, annak meg is kell felelni az <\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:32016R0679&amp;from=HU\"><span style=\"font-weight: 400;\">\u00c1ltal\u00e1nos Adatv\u00e9delmi Rendelet (GDPR)<\/span><\/a><span style=\"font-weight: 400;\"> \u00e9s a NAIH elv\u00e1r\u00e1sainak. <\/span><b>Ehhez a Hat\u00f3s\u00e1g fel is sorolta az \u00e9rdekm\u00e9rlegel\u00e9si teszt k\u00f6telez\u0151 tartalmi elemeit.<\/b><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Az \u00fcgyben m\u00e9g az a probl\u00e9ma is el\u0151ker\u00fclt, hogy <\/span><b>a civil szervezet jogosult-e tov\u00e1bb kezelni az adom\u00e1nyoz\u00f3k szem\u00e9lyes adatait tov\u00e1bbi megkeres\u00e9sek \u00e9s adom\u00e1nyk\u00e9r\u00e9sek c\u00e9lj\u00e1b\u00f3l. <\/b><span style=\"font-weight: 400;\">Term\u00e9szetesen ennek semmi akad\u00e1lya nincs, megfelel\u0151 jogalap birtok\u00e1ban. Ez a jogalap pedig \u00e1ltal\u00e1ban az \u00e9rintett egy\u00e9rtelm\u0171 \u00e9s konkr\u00e9t <\/span><b>hozz\u00e1j\u00e1rul\u00e1sa <\/b><span style=\"font-weight: 400;\">kell, hogy legyen. Nem tekinthet\u0151 azonban az \u00e9rintett hozz\u00e1j\u00e1rul\u00e1s\u00e1nak, ha a civil szervezet sz\u00e1m\u00e1ra b\u00e1rmikor a kor\u00e1bbiakban adom\u00e1nyt juttatott.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Sz\u00e9pen l\u00e1that\u00f3 teh\u00e1t, hogy az adatv\u00e9delem egy olyan ter\u00fclet, ahol <\/span><b>nem elegend\u0151 a r\u00e9szleges megfelel\u00e9s, vagy egy f\u00e9lig k\u00e9sz munka.<\/b><span style=\"font-weight: 400;\"> A Hat\u00f3s\u00e1g d\u00f6nt\u00e9s\u00e9ben kiemelte, hogy b\u00e1r l\u00e1tszott, hogy az adatkezel\u0151 rendelkezik k\u00fcl\u00f6nb\u00f6z\u0151 dokumentumokkal, azok egy\u00e1ltal\u00e1n nem festettek azonos k\u00e9pet az \u00e1ltala v\u00e9gzett adatkezel\u00e9sekr\u0151l \u00e9s a k\u00f6telez\u0151en elk\u00e9sz\u00edtend\u0151 \u00e9rdekm\u00e9rlegel\u00e9sek sem tartalmaztak minden sz\u00fcks\u00e9ges szempontot.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Mi a tanuls\u00e1g?
