A Facebook ugyanis a felhaszn\u00e1l\u00f3k szem\u00e9lyes adatainak birtok\u00e1ban c\u00e9lzott hirdet\u00e9si szolg\u00e1ltat\u00e1sokat k\u00edn\u00e1l a platformon, amelyb\u0151l \u00f3ri\u00e1si bev\u00e9telre tesz szert.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A K\u00faria azonban a k\u00f6zelm\u00faltban <\/span><a href=\"https:\/\/www.jogiforum.hu\/blog-versenyjog-blog-12\/2021\/11\/25\/fordulat-a-facebook-versenyugyeben-a-kuria-szerint-megsem-szamit-formalis-fizetsegnek-az-adataink-megosztasa-egyelore\/?fbclid=IwAR1SdawWOJYdhcoJcMCR0jl1vrHQ04lC0Jm0TH1djndvIKXUdeOdMNjL7dE\"><span style=\"font-weight: 400;\">megsemmis\u00edtette<\/span><\/a><span style=\"font-weight: 400;\"> a GVH d\u00f6nt\u00e9s\u00e9t, mert \u00fagy tal\u00e1lta, hogy b\u00e1r val\u00f3ban felvethet\u0151 az, hogy az ellenszolg\u00e1ltat\u00e1s fogalma a digit\u00e1lis szolg\u00e1ltat\u00e1sok kor\u00e1ban \u00e1t fog alakulni, ugyanakkor a GVH a k\u00e9rd\u00e9ses \u00fcgyben t\u00fall\u00e9pte a hat\u00e1sk\u00f6r\u00e9t a b\u00edrs\u00e1g kiszab\u00e1sa sor\u00e1n. A K\u00faria szerint ugyanakkor az ellenszolg\u00e1ltat\u00e1s fogalma nem sz\u0171k\u00edthet\u0151 le a kiz\u00e1r\u00f3lag p\u00e9nzbeli ellenszolg\u00e1ltat\u00e1sokra, hanem ebbe tartozik minden olyan fogyaszt\u00f3i h\u00e1tr\u00e1ny is, amely jelent\u0151s, \u00edgy teh\u00e1t a fogyaszt\u00f3 \u00fcgyleti befoly\u00e1sol\u00e1s\u00e1ra k\u00e9pes vagy alkalmas, illetve amely r\u00e1ad\u00e1sul k\u00f6zvetlen\u00fcl is hat a fogyaszt\u00f3ra.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A K\u00faria szerint a Facebook eset\u00e9ben ilyen h\u00e1tr\u00e1ny nem val\u00f3sul meg, ugyanis a c\u00e9lzott hirdet\u00e9sek \u00e1ll\u00e1spontja szerint nem okoznak t\u00f6bbleth\u00e1tr\u00e1nyt az \u00e1ltal\u00e1nos rekl\u00e1mokhoz k\u00e9pest. Nem k\u00e9rd\u0151jelezhet\u0151 meg p\u00e9ld\u00e1ul egy ingyenes \u00fajs\u00e1g ingyenes jellege csak az\u00e9rt, mert abban rekl\u00e1mok is tal\u00e1lhat\u00f3k.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hasonl\u00f3 probl\u00e9ma mer\u00fclt fel az <\/span><a href=\"https:\/\/caselaw.findlaw.com\/us-federal-circuit\/1878050.html\"><span style=\"font-weight: 400;\">Art+Com v. Google <\/span><\/a><span style=\"font-weight: 400;\">\u00fcgyben is, ahol a Google Earth \u00e1ll\u00edt\u00f3lagos alapj\u00e1ul szolg\u00e1l\u00f3 Terra Vision szoftver n\u00e9met fejleszt\u0151i pr\u00f3b\u00e1lt\u00e1k \u00e9rv\u00e9nyes\u00edteni szabadalmi jogosults\u00e1gaikat a Google-el szemben. A Google ebben az \u00fcgyben is arra hivatkozott, hogy mivel a Google Earth egy ingyenes alkalmaz\u00e1s, azzal bev\u00e9telt k\u00f6zvetlen\u00fcl nem termel. Ez azonban a Google integr\u00e1lt rendszer\u00e9nek f\u00e9ny\u00e9ben legal\u00e1bbis megk\u00e9rd\u0151jelezhet\u0151 \u00e1ll\u00edt\u00e1s.
